Welcome to DSB Market (“DSB Market,” “we,” “our,” or “us”). These Customer Terms of Use (“Terms”) govern your access to and use of our websites, mobile apps, software, and any services that reference these Terms (collectively, the “Services”). By using the Services, you agree—on behalf of yourself and anyone who uses the Services under your account—to these Terms and to all policies referenced below.

If you do not agree, do not use the Services.

Related Policies. Our Privacy Policy, Refunds & Returns Policy, Cookies Notice, and any other guidelines or policies posted on the Services are incorporated into these Terms. If a conflict exists between these Terms and any specific policy or service-level guideline, the specific policy or guideline will control for that feature.

1) Who We Are & Marketplace Role

DSB Market operates a multi-vendor marketplace. In most cases, products are listed, sold, and fulfilled by independent third-party sellers (“Vendors”). Unless we explicitly say otherwise, DSB Market is not the seller of record and does not take title to items you purchase from Vendors. Vendors are responsible for their listings, inventory, pricing, shipping, tax collection where applicable, and compliance with law. We provide the platform, payment rails, and customer experience standards.

2) Eligibility & Your Account

• Age. You must be at least 18 to create an account and make purchases. If you are under 18, you may use the Services only with the involvement of a parent or legal guardian. Certain categories (e.g., alcohol or age-restricted items) may require the purchaser to be 21+ and may require ID verification upon delivery.

• Accuracy. You agree to provide and maintain accurate account, contact, and payment information.

• Security. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

• Actions We May Take. We may refuse service, suspend or terminate accounts, cancel orders, or remove content if we believe these Terms, applicable laws, or platform policies are violated or to protect our users or the platform.

3) Electronic Communications

When you use the Services or send us emails, texts, or messages, you may be communicating with us electronically. You consent to receive communications from us electronically (e.g., email, SMS, in-app messages, notices on the site). You may retain copies for your records. You agree that electronic communications satisfy any legal requirement that such communications be in writing. Message and data rates may apply.

4) License & Acceptable Use

We grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal, non-commercial use of the Services, strictly as permitted by these Terms and applicable policies.

You may not:

• resell or commercially exploit the Services or their contents;

• copy, scrape, crawl, index, mine, harvest, or use robots or similar tools—except as allowed by our robots.txt and only to the extent legally permitted;

• frame or mirror any part of the Services without our prior written consent;

• use or repurpose any content from the Services (including user reviews, images, prices, or listings) to train, improve, or validate AI, machine learning, or large language/multimodal models without our express written permission;

• bypass, disable, or interfere with security or access controls;

• use the Services in violation of law or these Terms.

All rights not expressly granted are reserved by DSB Market and our licensors.

5) Intellectual Property

All content on or made available through the Services—including text, graphics, logos, icons, images, audio/video clips, downloads, data compilations, and software—is owned by DSB Market or its content suppliers and protected by U.S. and international IP laws. The compilation of all content is the exclusive property of DSB Market. Our names, logos, and trade dress may not be used without our prior written consent. Third-party marks remain the property of their respective owners.

6) User Content: Reviews, Comments & Submissions

You may post reviews, ratings, questions, photos, videos, and other content (“User Content”) so long as it is lawful and respectful. Prohibited content includes anything illegal, obscene, defamatory, harassing, hateful, infringing, invasive of privacy, misleading, or containing malware, spam, political campaigning, or commercial solicitation.

By posting User Content, you grant DSB Market a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and perform that content in any media, with the right to use the name or username you submit in connection with it. You represent that you own or control the necessary rights and that your content is accurate and compliant. We may monitor, remove, or edit User Content at our discretion but are not obligated to do so.

7) Listings, Product Descriptions & Pricing

Vendors are responsible for their listings and product information. We strive for accuracy but do not guarantee that descriptions, images, availability, or prices are error-free, complete, or current. If an item is not as described, your remedy is to return it in unused condition in accordance with our Refunds & Returns Policy.

Reference prices or “compare at” prices, if shown, are provided for comparison and may be based on information supplied by Vendors, the manufacturer, or our own pricing history or market data.

8) Orders, Payments, Risk of Loss & Title

• Payments. You authorize us (and our payment providers) to charge your selected payment method for the full order amount, taxes, shipping, and any applicable fees. If your primary payment method fails, you permit us to charge another valid method on file.

• Risk of Loss & Title. For Vendor-fulfilled items, risk of loss and title pass from the Vendor to you upon delivery to the carrier (or as otherwise stated by the Vendor’s shipping terms), except where law requires otherwise. For items fulfilled by DSB Market (if any), risk of loss and title pass to you upon delivery to your address or point of pickup.

• Cancellations. Orders may be canceled by us or a Vendor for reasons such as suspected fraud, inventory errors, pricing issues, or shipping restrictions. You will not be charged for canceled orders; if already charged, we’ll refund the amount.

9) Refunds, Returns & Exchanges (Customer Summary)

• Return Window. Unless labeled non-returnable, most items are eligible for return within 30 days of delivery, in unused, original condition with packaging and all materials.

• Process & Timing. Follow the return instructions in your account. Refunds are typically processed to the original payment method after the item is received and inspected by the Vendor or fulfillment center. Certain categories (e.g., perishables, digital items, customized goods) may have limited or no returns—see the product page and our Refunds & Returns Policy for details.

• Return Shipping. If free returns apply, you’ll receive a prepaid label. Otherwise, you’re responsible for return shipping and risk of loss during return transit unless the Vendor or DSB Market is at fault.

10) Third-Party Services, Stores & Links

Other businesses list products, operate stores, or provide services, software, or content through the Services. When you purchase from or interact with a third party, you’re transacting directly with that party, not DSB Market. We do not control or warrant third-party offerings and are not responsible for their actions, products, content, or websites. Review their terms and privacy notices before engaging.

11) Software Terms (Apps & Site Software)

Any software we provide (including app updates/upgrades) is licensed, not sold, to you solely to enable your use of the Services per these Terms:

• You may not copy (beyond necessary backup), modify, reverse engineer, decompile, disassemble, or create derivative works from the software, or bypass any security.

• We may deliver automatic or manual updates at any time.

• If open-source components are provided, the applicable open-source licenses will govern those components where they conflict with these Terms.

• No AI/Model Use. You may not use any software, data, or outputs from the Services to create, train, improve, or validate AI/ML models without our express written permission.

12) Sanctions & Export Controls

You may use the Services only if you are not subject to U.S. sanctions and only in compliance with all applicable U.S. export and re-export laws and regulations. You may not purchase or ship items to prohibited destinations or end users.

13) Prohibited & Restricted Items

Certain products or categories may be restricted or prohibited by law or by our policies (e.g., hazardous materials, recalled goods, counterfeit items, age-restricted products). Listings that violate laws or our policies may be removed, and orders may be canceled.

14) Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and share information, including details about call/SMS communications, cookies/identifiers, surveys, contests, and security measures. Please review it carefully.

15) Warranties, Disclaimers & Limitation of Liability

AS-IS BASIS. The Services—and all information, content, materials, products, software, and other services included on or otherwise made available to you through the Services—are provided “as is” and “as available”, without warranties of any kind, unless expressly stated in writing.

To the maximum extent permitted by law, DSB Market disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, quiet enjoyment, non-infringement, and those arising from course of dealing or usage of trade. We do not warrant that the Services, information, content, or communications are error-free, secure, or free of viruses or harmful components.

LIMITATION OF LIABILITY. To the fullest extent permitted by law, DSB Market and our affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, punitive, special, or consequential damages, or lost profits or revenues, arising from or related to your use of the Services or any products, even if advised of the possibility. Our total liability for any claim will not exceed the amount you paid for the product or service giving rise to the claim.

Some jurisdictions do not allow certain disclaimers or limitations; parts of this section may not apply to you.

16) Indemnification

You agree to defend, indemnify, and hold harmless DSB Market, our affiliates, and our and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your breach of these Terms or policies, or your violation of law or third-party rights.

17) Disputes, Governing Law & Venue

These Terms and any dispute or claim arising out of or related to them or the Services are governed by U.S. federal law and the laws of the State of Illinois, without regard to conflict-of-law principles.

Venue. All disputes will be adjudicated exclusively in the state or federal courts located in Cook County, Illinois, and you consent to personal jurisdiction and venue in those courts.

Waivers. To the fullest extent permitted by law, both parties waive any right to a jury trial and agree that disputes will be brought only on an individual basis and not as a class, consolidated, or representative action.

18) Modifications; Termination; Assignment

We may update the Services, policies, and these Terms at any time. If we make material changes, we will provide notice (e.g., by posting an update date at the top of these Terms or sending an email/notice in your account). Continued use of the Services after changes become effective constitutes acceptance.

We may suspend or terminate your access for any reason, including violations of these Terms. We may assign these Terms (in whole or in part) without notice. You may not assign or transfer your rights or obligations without our prior written consent.

19) Severability; Entire Agreement; No Waiver

If any provision of these Terms is found invalid or unenforceable, that provision will be narrowed or severed to the minimum extent necessary, and the remaining provisions will remain in full force. These Terms (plus incorporated policies) are the entire agreement between you and us regarding the Services. Our failure to enforce a provision is not a waiver of our right to do so later.

20) DMCA / IP Complaints

We respect intellectual property rights. If you believe content on the Services infringes your copyright, please send a DMCA notice to our Copyright Agent with the following:

1. your physical/electronic signature;

2. identification of the copyrighted work;

3. identification of the material that is claimed to be infringing and its location (URL);

4. your contact information;

5. a statement of good-faith belief that the use is not authorized; and

6. a statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

21) Service of Legal Process

DSB Market accepts service of subpoenas and other legal process only via its registered agent: Corporation Service Company (CSC). Please serve CSC at its designated address for Illinois (or your jurisdiction) as listed with the Secretary of State. We do not accept service by email or fax. Include adequate identifying details (e.g., order numbers, account email, dates) to facilitate processing.
